Avery Berkel Brexit Statement

The ongoing negotiations between the UK and EU, regarding both the withdrawal agreement and post-Brexit trading relationship, are such that our current and future customers within the European Union and UK may be uncertain of the effect post-Brexit.

Avery Berkel is a wholly owned subsidiary of ITW Food Equipment Group, with other European businesses also including Hobart, Foster, Bonnet, Electrobar and MBM.

Avery Berkel would like to assure our partners and customers of the following points to provide assurance of our position regarding these concerns:

  • A working party, including the Senior Management Team and in association with other ITW European businesses, was established to monitor the Brexit negotiations and to form suitable contingency plans to ensure continued supply of goods and parts to and from the UK and European Union post-Brexit.
  • Dependant on the nature of the final trading arrangement between the UK and EU, it is possible that the European Union will insist that all new weighing scales placed on the market following Brexit will require an approval certificate from a notified body of the remaining EU27 nations. It is also possible that the UK will insist that all new weighing scales placed on the market following Brexit will require a UK NMO approval certificate.
    • Following 29th March 2017, once the UK government triggered Article 50, Avery Berkel made the pro-active decision to obtain ‘dual approval’ certificates for all core products to ensure continued legal approval irrespective of the final agreement.
  • Current European Union legislation, which will continue to apply to both the UK and EU following Brexit stipulates that weighing equipment is to be re-verified following a metrologically related repair.
    • The European Union issues guidance in the form of the ‘Commission Notice – The Blue Guide’ which states that weighing instruments may continue to be re-verified, even if the original approval certificate has expired.
      • Scales installed in the UK under EU approval certificates will therefore continue to be re-verified after Brexit, even if new weighing equipment requires UK approval certificates
      • Scales installed in the EU under UK approval certificates will therefore continue to be re-verified after Brexit, even if new weighing equipment requires EU approval certificates.
  • Avery Berkel operates throughout the European Union, where the ITW footprint includes directly owned entities in several European countries including manufacturing plants, warehousing and offices. This footprint allows for immediate flexibility in the warehousing of new equipment and spare parts to provide security of supply following Brexit. Therefore, should a worse-case scenario, following ‘no-deal’ Brexit, result in immediate tariff and customs checks, warehousing in both the UK and European Union will provide normal supply timelines of parts and products to both the UK and to the EU.
  • As a global supplier of goods and parts, Avery Berkel’s business already includes a significant amount of trade with non-EU markets where there are already barriers to free trade, therefore this experience and knowledge will ensure that any abrupt trading changes between the UK and European Union are managed quickly and effectively.
